The terms that apply to using this website and working with us on a project.
1. About these terms
These Terms & Conditions govern your use of this website and, where applicable, any project work agreed with Twinspark Digital. By using this site or engaging us for a project, you accept these terms.
2. Use of this website
You may browse this site and use the contact form to reach us about a project. You agree not to:
- Use the contact form to send spam, unsolicited advertising, or automated bulk messages.
- Attempt to interfere with, disrupt, or gain unauthorised access to this site or its infrastructure.
- Copy or reuse the site's design, code, or written content for another project without our permission.
3. Project engagements
Details specific to a project, such as scope, price, timeline, and deliverables, are agreed separately with each client, typically by email or a written proposal. Where a separate written agreement exists for a project, that agreement takes priority over this page for matters it covers.
4. Payment
Payment terms, including any deposit, milestones, and final payment, are set out per project when the engagement is agreed. Work may be paused if agreed payment terms are not met.
5. Revisions and scope
Each project includes a number of revision rounds agreed at the outset. Requests that go beyond the agreed scope, such as new pages or features not originally discussed, may be treated as additional work and quoted separately.
6. Ownership
Once a project is paid in full, the client owns the final delivered website files and content created specifically for that project. Twinspark Digital retains the right to display the completed project in its own portfolio unless the client requests otherwise in writing. Any third-party assets used in a project, such as licensed fonts, stock images, or plugins, remain subject to their own licence terms.
7. Content provided by the client
Clients are responsible for the accuracy and legality of any text, images, or other material they provide for use on their site. We assume material supplied by a client is either owned by them or properly licensed for use.
8. Warranties and limitations
We aim to deliver working, tested websites, but we do not guarantee that a site will be completely free of defects at all times, particularly following changes made outside our control, such as third-party service outages or hosting issues. Our liability for any claim relating to a project is limited to the amount paid for that project.
9. Third-party links and services
This site links to third-party services, including Linktree and social platforms. We are not responsible for the content, availability, or practices of those external services.
10. Changes to these terms
We may update these terms from time to time. The "last updated" date at the top of this page reflects the most recent revision. Continued use of this site after changes are posted means you accept the updated terms.
11. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.
